Ashby has time shaved off sentence

The daughter of an Outrageous Fortune star has had time shaved off her home detention sentence after she ripped off her former employer.

But 28-year-old Alix Ashby - whose father Kirk Torrance played Detective Sergeant Wayne Judd in the hit West Auckland drama - still owes marketing company Brand Spanking more than $14,000, which is due to be paid next week.

She worked as a talent booker at the company for just over a year from mid-2011, during which time she stole almost $25,000, syphoning cash into two of her own bank accounts.

At sentencing in May, Judge David Harvey slapped Ashby with a 10-month term of home detention, 275 hours of community work and ordered to repay the money she stole.

"What you did was not just stick your hand into the till and put the money in your pocket. It was an elaborate, sophisticated, well thought-out process to channel money into your own bank account," Judge David Harvey said.

But in the High Court at Auckland this afternoon, Justice Mark Woolford ruled the sentence was manifestly excessive.

It is compulsory for judges to take into account a defendant's remorse and previous good character when arriving at a penalty but Justice Woolford said Judge Harvey had overlooked those aspects.

The High Court judge awarded "modest discounts" for both factors, which took Ashby's term of home detention down to eight months.

The community work and reparation orders remained in place.

Ashby was not at court for today's hearing.

Only weeks into the job, she began siphoning money into her own accounts, making it look as though she was paying contractors on behalf of the business.

She said she was addicted to methamphetamine at the time but Judge Harvey said that was "far in the background".

"You had the opportunity to access your employer's computer system and you took those opportunities for your own selfish circumstances," he said.
