An Auckland herbal impotence pill company may have broken the
law by using the logo of drug regulation agency Medsafe on
its website to imply the "natural virility" product is a
registered medicine.
Herbal Ignite's website featured the logos of Medsafe and
Australia's Therapeutic Goods Administration until yesterday,
when the logos were removed following a complaint from
Medsafe, New Zealand Doctor newspaper reported.
Medsafe compliance manager Derek Fitzgerald said it did not
give permission for its logos to be used and did not approve
or endorse Herbal Ignite.
The company had been told it could not make therapeutic
claims for the product, he said.
"Making therapeutic claims for such a product establishes
that the product is a medicine and, as it is not 'approved'
as a medicine in New Zealand, this could be a breach of
section 20 of the Medicines Act."
He said no further action would be taken at this stage but
the website's content was being reviewed.
Herbal Ignite director Jenny Wheeler said the logo was
probably put on the website by an "overzealous" web designer.
