No charges will be laid against a Wanaka taxi driver who ran over a Dutch tourist more than two months ago, police announced yesterday.

Coen van Rosmalen (24) was struck by a Toyota taxi in Beacon Point Rd, Wanaka, about 3.30am on Sunday, September 14.

He was lying on the road before he was hit.

Why he was there has been the focus of a lengthy police investigation into his death.

Detective Senior Sergeant Colin Blackie said based on witness statements, forensic evidence and vehicle and scene examination, including street lighting around the accident spot, police had ruled out charging the taxi driver over the fatality.

The decision had been ''definitely my recommendation from the outset'', Det Snr Sgt Blackie said.

However, his recommendation had to be reviewed by several other senior police staff before a final conclusion was reached.

''In cases of death, we have to be so certain that we get the decision right.

''And all the time I've felt for the key parties - the victim's family, the taxi driver, the taxi owner - that the delay, although justified, has been significant.''

Mr van Rosmalen's family in the Netherlands, the taxi company and the driver concerned had been advised of the police decision not to lay charges.

Det Snr Sgt Blackie said because the matter had been referred to the coroner for a ruling on cause of death, police could not discuss Mr van Rosmalen's toxicology results or medical history data.

''I can say that we are still waiting for the victim's blood sugar levels to be resulted, although whatever those turn out to be will not have an impact on our decision not to charge the taxi driver.''

Wanaka's Yello! taxi company co-owner Hamish Fraser declined to comment yesterday.
