Jaw smasher to pay $12,000

An Australian stonemason has been ordered to pay $12,000 to a man after shattering his jaw in an alcohol-fuelled attack in Queenstown.

Benjamin Alexander Stahr (29) was also sentenced to seven months' home detention and 150 hours' community work.

His victim Olivier Ramanoel (35) had facial reconstruction surgery - a metal plate and screws were inserted.

He will need ongoing treatment, including further surgeries.

The attack happened just metres from where father-of-two Mark Smith was killed after being knocked to the ground with a single punch in November 2009.

Appearing for sentencing yesterday at Queenstown District Court, Stahr admitted one charge of injuring Mr Ramanoel in such circumstances that if death had been caused he would have been guilty of manslaughter, on September 3.

Judge Bernadette Farnan said Stahr was ''extremely lucky'' not to be facing a more serious charge.

''You could well have killed this man and I'm sure on reflection you acknowledge that,'' Judge Farnan said.

Defence counsel Bill Dawkins said his client admitted punching his victim twice after brief words were exchanged on Camp St, about 11.45pm that day.

Stahr's two punches left his victim with significant injuries.

''He feels his face is now deformed,'' Judge Farnan said.

Judge Farnan said the victim impact statement confirmed Mr Ramanoel, a tour guide who lives in Auckland, had his jaw broken and dislocated.

It has left the victim's bite misaligned.

The punches also partially detached his right ear.

Mr Ramanoel is due to have surgery next month to remove the plate and push his teeth back to realign his jaw. Further surgeries might be required after that procedure.

''The surgeon told him he is likely to have trouble with his teeth for the rest of his life,'' Judge Farnan said.

Mr Dawkins said his client accepted his actions were ''completely unjustified'' and felt genuine remorse.

Judge Farnan began with a starting point of 27 months' imprisonment but reduced that by 40% with credit for Stahr's early guilty plea, remorse and offer of reparation.

The 16-month jail term was converted into seven months' home detention.

He must also pay $12,000 in reparation to his victim. Stahr, of Bayswater, Victoria, will serve out his sentence at a Christchurch address.

He must attend and complete any programmes or treatment determined by his probation officer, but Judge Farnan did not impose any post-release conditions.

He was convicted and discharged on a charge of stealing Mr Ramanoel's $50 baseball cap.
