Appeal distressing, victim's family says

The family of an Oamaru 5-year-old killed by a tourist driver say the appeal lodged by the driver has brought back the pain and heartbreak of her death.

Jing Cao (32), of China, was sentenced to 18 months' jail when he appeared before Judge Kevin Phillips in the Dunedin District Court on June 9, for dangerous driving causing the death of Ruby Marris.

An appeal against the sentence was filed the following day and will be heard in the Dunedin High Court on Monday.

Cao crashed into the Marris family's station wagon in his rented Ford Ranger near Moeraki on February 21.

Ruby's parents, Tristan and Kimberley Marris, suffered serious injuries in the crash and her sisters, Georgia and Sophie, had moderate injuries.

Mrs Marris told the Otago Daily Times she would be at Monday's appeal hearing in Dunedin and had asked to speak in front of the judge.

She had not been told if her request would be granted.

The appeal had brought back the heartache and pain of Ruby's death, Mrs Marris said.

''Mr Cao has made this a very drawn-out process for the Marris and Cant families and it's been very distressing,'' she said.

If Cao was ''as sorry as he said he was at the previous sentencing'', she questioned why he had appealed his sentence.

In addition to the 18-month jail sentence, Cao was sentenced to nine months' jail (to be served concurrently) on each count of dangerous driving causing injury to the other four Marris family members as well as Cao's mother, who was a passenger in his rented vehicle, and ordered to pay $27,500 emotional harm reparation to the Marris family and further reparations of $34,390.
