Man on murder charge dies in prison

The man who died in Otago Corrections Facility last month was accused of murdering a Southland toddler.

Southland Crown solicitor Mary-Jane Thomas confirmed the man, aged in his 30s, who died in the Milburn facility on November 22, was accused of murdering a 17-month-old toddler at Wallacetown, near Invercargill in October.

The man had pleaded not guilty to the charge and had elected trial by jury.

Ms Thomas said a stay in proceedings would be filed with the High Court.

''The standard thing [after the accused dies] is to seek a stay,'' she said.

The man had interim suppression and the matter would be ''readdressed the next time it is called'', she said.

The case is set down for a pre-trial case management hearing on February 2.

Otago Corrections Facility prison director Jack Harrison told the Otago Daily Times last week the man was found in an ''unresponsive state'' by staff about 10.30pm on November 22.

''Staff ... provided medical attention. However, he was pronounced dead at the scene,'' he said.

Police were investigating the death on behalf of the coroner.

It is understood the death is not being treated as suspicious and no-one else is sought in connection with it.
