An Environment Court judge has approved a mediated agreement that gives the green light to a 118-lot residential development in Mosgiel.
Judge Jon Jackson, of Christchurch, in a written decision, has approved the amended conditions agreed to by Otago Business Park Ltd and the Dunedin City Council through mediation.
It resolved the appeal by Otago Business Park Ltd on conditions imposed by a hearings panel in its November 2010 approval of a resource consent to build the subdivision off Gladstone Rd.
Director Allan Dippie said last night the successful negotiations enabled changes to the consent conditions, making them less onerous.
"It's quite a good outcome. We are happy to proceed."
One condition appealed was the requirement to maintain a stormwater reserve for 10 years before the council took it over.
Under the new agreement, Otago Business Park would maintain the reserve for only three years and provide a bond of $10,000.
At the end of the three years, the bond should be released when the council was satisfied maintenance works had been completed to the satisfaction of the resource consents manager.
Another condition required the company to provide detailed specifications of the subdivision water reticulation plans to the council for approval before the start of any works. Since agreement had been reached, the company had been finalising the subdivision design and getting ready to put work out to tender, Mr Dippie said.
Tenders would go out for stage one, 45 residential sections, of the three-stage project soon. It was not known when work would start.
While the past 18-24 months in the residential housing market had been difficult, he was confident the development would appeal to buyers, he said.
A name for the development was still to be chosen.
