Bain retrial start delayed

The start of David Bain's retrial has been pushed back at least four days as several legal challenges remain undecided.

The jury for the trial is now due to be empanelled on Friday, March 6, not Monday, March 2, as previously scheduled. The rescheduling was at the agreement of both the defence and the Crown, the High Court registrar in Christchurch, Helen Vermeulen, said in a short statement last night.

Legal battles surrounding Bain's retrial are still being fought out in various courts this week, as both sides wait for a decision on a defence argument the charges against Bain should be dropped altogether.

The defence argued its case in a four-day pre-trial hearing before two judges in Christchurch last week and a decision on that is not expected until the end of the week.

Bain is charged with the murders of his father, mother, two sisters and brother in Dunedin in 1994.

He served 13 years in jail before he was bailed when the Privy Council overturned his convictions in 2007.

Bain's defence team was also granted leave by the Supreme Court on Monday to appeal on a different matter. That appeal is to be heard today.
