Drink-driver sentenced to jail for injury accident

"People should be able to drive around safely without this sort of thing happening," Judge Dominic Flatley told a drink-driver who crashed into a motorcyclist, injuring him.

Angela Marie Whelan (37), of Dunedin, had been convicted of causing injury while driving with a breath-alcohol level of 963mcg, on November 23.

She was before the Dunedin District Court yesterday after pleading guilty.

The judge sentenced her to 11 months’ jail (with six months’ release conditions), disqualified her from driving for 18 months, and ordered her to pay $500 emotional harm reparation.

The crash occurred in Wharf St, near the intersection with Kitchener St, about 4.45pm.

Whelan, after being parked in the driveway of a business, drove into the path of the victim and crashed into the left side of his motorcycle causing him to fall on to the median strip.

The victim was knocked unconscious and remained on the median strip where he was treated by ambulance staff. Whelan stopped her car and checked on the victim, then collected her front bumper and drove to a nearby petrol station leaving the victim unattended.

She returned to the crash scene a short time later and spoke to police. Her breath-alcohol level was 963mcg.

She admitted having drunk two large glasses of wine about half an hour before driving.

The victim required surgery for a broken bone in his left leg. He also had extensive bruising to his left ankle, left elbow and lower back and was in hospital for eight days.

Judge Flatley noted Whelan had a drink-drive conviction (breath-alcohol level 1078mcg) in 2007. He also noted she had not been before the court for any offending since 2014.
