Auckland International Airport is disappointed that the Craigie Trust intends to take a dispute over land to the Supreme Court.
The airport operator said it would oppose a Craigie Trust's application for leave to appeal to the Supreme Court and would strongly defend any appeal if leave was granted.
A Court of Appeal decision in December 2009 upheld the earlier High Court ruling in favour of Auckland Airport.
The dispute is about 36 hectares of land acquired under the Public Works Act from the Craigie Trust.
Auckland Airport spreads over 1500 hectares of land, according to the company's website. In the case, the courts interpret section 40 of the Public Works Act which covers an obligation to offer land back to the former owner if it is no longer required for public work purposes.
