Police pair seek to have convictions quashed

Two Dunedin police officers found guilty of using excessive force on an offender are seeking to have their convictions overturned.

The jury verdicts on Constables Brenton David Rooney, 33, and Duncan Roy Hollebon, 37, after a District Court trial in June last year were "unreasonable", their lawyers told the Court of Appeal today.

Rooney was sentenced to two months' community detention and 100 hours' community work for intentionally injuring Daniel Murray Wiel in February 2009.

Hollebon got 160 hours' of community work for assaulting Mr Wiel with intent to injure him. Both constables were ordered to pay $500 reparation to the complainant, who had been pursued by police when seen riding a motorcycle around Dunedin city streets without lights and not wearing a helmet.

Before Justices Ellen France, Judith Potter and Forrest Miller, lawyers John Farrow for Rooney and Anne Stevens for Hollebon applied to have the convictions quashed.
