Laniet Bain shot three times

Laniet Bain had blood on the inside of both closed fists and three bullet wounds were found on her head, the retrial of her brother David Bain was told at the High Court in Christchurch today.

Bain denies murdering his mother, father, two sisters and a brother at their home in Dunedin in 1994 at his retrial before Justice Graham Panckhurst and a jury.

Live and spent cartridges were found through the bedroom in the Bain family home at Every Street, Dunedin, where Laniet Bain's body was found lying in bed, the court was told.

A CIB detective, Stephen Murray, said the police found a spent cartridge case on a writing desk, and one on an apron on the floor. A live bullet was on a jersey on the floor and another had fallen into a black bag.

Another spent shell was found later when the clothing was moved.

Hayley Stewart, an ex-police constable with the CIB, said Laniet Bain was lying flat on her back with her head angled to the right. She had one bullet wound between her left ear and left eye, another above her left ear, and a third wound at the top of her head.

Three bullet fragments were found during her autopsy.

Jenepher Glover, a detective constable in 1994, said there were blood splatters on the wardrobe at the foot of her bed on a dollshouse on top of it.

The light switch also had a smear of blood on it.

More blood splatters were on the window, windowsill, and wallpaper in her room.

The trial had earlier heard about on-going arguments between mother Margaret Bain and father Robin Bain about building a new house.

In the room where Laniet Bain was found, there was a draughting board with plans for a new house, with quotes for building equipment and a Dunedin City Council application for building consent.

There were building booklets and books including How to Get the House you want, in the room.
