Acquitted double murder accused Chris Kahui wants custody of the surviving child he said caused the fatal injuries to his twin sons.

Kahui, 23, was found not guilty of the murder of three-month-old twins Chris and Cru by a High Court jury in Auckland yesterday after a six-week trial.

The babies died 14 hours apart on June 18, 2006, in Auckland's Starship Children's Hospital from head injuries, several days after they were taken in by Chris Kahui and his then partner Macsyna King.

Police later said the injuries were deliberate and it was a double murder but yesterday after the jury verdict the officer in charge, Detective Inspector John Tims said the case would be closed and no one else would be charged over the deaths.

Last month Chris Kahui said if the jury returned a not guilty verdict he would apply for custody of Shane, now aged three.

During the trial Mr Kahui said the twins' mother Macsyna King caused the fatal injuries after initially saying Shane, who was one when the twins died, could have caused them.

Mr Kahui was expected to go to the Family Court to seek custody of Shane who was now being cared for by Child Youth and Family and believed to be living with a foster family in Gisborne.
