A Dunedin man who confessed to being "gone burger" narrowly avoided prison after his sixth conviction for high-level drink-driving.
At 10.35pm on September 10 last year, Graeme Shaw (54) was seen by police driving erratically in North East Valley, the Dunedin District Court heard yesterday.
On being pulled over, Shaw admitted to consuming alcohol, and told police he was "gone burger". A breath test revealed a level of 1156mcg — more than four times the legal limit.
Shaw stated he had intended to sleep in his car in the pub car park, but was informed by staff he should not as police would check the area.
"Your history is of real concern to me. There is a risk of tragic consequence."
After the judge considered jail time, Shaw was sentenced to four months’ community detention, 12 months’ intensive supervision and disqualified from driving for 28 days after which he would be subject to alcohol-interlock provisions.
"You need to change your behaviour around drinking, particularly drinking and driving," Judge Flatley said.
