Privy Council to consider petition asking for Bain's acquittal

The Privy Council will hold a preliminary hearing in London on December 8 to consider a petition requesting it fully acquit David Bain of the 1994 killings of his immediate family in Dunedin.

Bain's previous murder convictions for the deaths were set aside by the Privy Council in May 2007.

The council ordered a re-trial and a fresh trial is due to begin next February.

The petition is a rare attempt to have the Privy Council recall their decision granting Bain a retrial and relates to new evidence the defence team were unaware of when they argued for Bain's retrial.

The head of Bain's defence team, Auckland lawyer Michael Reed QC, said the council would consider at the Decemer 8 hearing whether it would hold a full hearing on the petition. He could not make any other comment on the matter, he said.
