'Perverted' chef made intimate recordings of partner as she slept

‘‘Sneaky and opportunistic’’ recordings of his partner landed a man in the Alexandra District Court yesterday.

Jesse Millan, 20, chef, of Clyde, admitted making an intimate visual recording of his former partner.

When spoken to by police, Millan admitted the offending and said he was ‘‘embarrassed and perverted’’.

The victim read a statement to the court describing the impact of the offending on her.

She said, as a consequence of Millan’s actions, even rest no longer felt safe for her.

In sentencing Millan, Judge Emma Parsons said he had taken two videos and one photograph of the victim while she was sleeping, without her knowledge or consent.

The victim’s impact statement was an articulate reading of her experience of the abuse, Judge Parsons said.

Making the recording while the victim slept meant she was vulnerable and could not consent.

‘‘It was unconsented and surreptitious and the photo and recording was done in a sneaky and opportunistic way,’’ Judge Parsons said.

While there was no evidence or suggestion the images had been shared, the effect on the victim had been profound.

‘‘The room was quiet as everyone was listening to the impact of the experience on her,’’ Judge Parsons said.

Millan’s lawyer Isobelle Hazlett said it was an example of poor decision-making common in males under 25 years old.

He had admitted the offending at the first opportunity and offered a letter of apology, to attend restorative justice meeting and $500 reparation for emotional harm, she said.

The victim had refused all of Millan’s offers.

The court had to focus on the offending, not the relationship as described by the victim in her statement, Ms Hazlett said.

Police prosector Ian Collin said the offending went beyond poor decision-making as actual harm had been caused as the court had heard from the victim.

Millan was sentenced to 12 months’ supervision with conditions including to attend programmes as directed.
