Issues over bar owner's attitude

The ''completely unsatisfactory'' attitude of a Dunedin bar owner to the requirements of the Sale of Liquor Act has resulted in the city council and police recommending her application for a third temporary authority to run the bar be rejected.

Madeleine McCoy, the sole shareholder of Hole in the Wall Ltd, has applied for an authority for the George St bar Mou Very.

Hole in the Wall was granted a temporary authority in February so the premises could be operated according to the underlying licence until a permanent licence was applied for and granted.

The temporary authority was extended in May because of pending legislative changes, in anticipation of the business applying for a permanent licence.

A third application for a temporary authority was lodged on August 20, while the full licence application was received on August 22.

In a report to the Dunedin District Licensing Agency Committee, which will determine the matter after a hearing, the city council's liquor licensing and projects officer, Kevin Mechen, said police opposed granting a temporary authority because of issues arising during the time the applicant had been operating the bar that had left them questioning her suitability to hold a liquor licence.

That included police finding no certified manager on duty during a monitoring visit.

When spoken to about this, Ms McCoy commented that the manager's certificate was ''just a piece of paper''.

Another time, a compliance check revealed food requirements were not being met, to which Ms McCoy responded that the small bar did not have a kitchen because of its size, so it was unfair to expect it to have the range of food required.

There had also been a history of non-compliance with the council's footpath policy, Ms McCoy suggesting the barriers she was required to use were ugly and blocked the footpath.

She did not appear to take her responsibilities seriously, Mr Mechen said.

Therefore, he joined the police in opposing her application.

The committee will consider the application at a public hearing on Wednesday.
