A Maritime New Zealand investigation has resulted in no compliance action being taken after three passengers on a tour boat fell overboard while crossing Otago Harbour.
The incident, on a boat operated by Port To Port Cruises and Wildlife Tours Ltd, happened on November 15 last year.
A person was taken to Dunedin Hospital with moderate injuries, along with two others who received minor injuries.
A subsequent Official Information Act request to Maritime New Zealand (MNZ) revealed the incident happened in choppy conditions when a large wave caught the vessel on the port bow and heavily listed it, the three passengers being tossed overboard.
All three were retrieved but one had injured their back on a railing, the response said.
MNZ general regulatory operations manager south John Drury said after an investigation it had decided against taking compliance action.
"The investigation found the operator had good operational policies and safety procedures in place prior to the incident, and as a result of changes made following it, these have been improved even further."
