ERA rejects costs claim

The Employment Relations Authority has determined there is "no basis" for a former Lakes District Museum employee to claim $1940.72 in expenses.

ERA member Helen Doyle said in her determination, dated September 26, that the museum's former retail and administration manager Bridget McDonald and the museum reached a "full and final settlement" through mediation after her redundancy last year.

On August 17, the ERA received a letter from Ms McDonald saying the matter had been resolved and she had withdrawn her personal grievance, but she also wanted to apply for costs and expenses incurred.

However, the museum's solicitor, Erin Gray, said there had been a "full and final" settlement. Ms McDonald had no basis to apply for costs and was "in breach of the agreement by doing so".

Ms Doyle agreed with Ms Gray and did not consider a penalty or cost award payable to the museum appropriate.
