More than $120,000 in fines and reparation have been imposed on three companies and a director over the death of a young girl who was crushed under a falling gate.
Shaelian Mary Rae Ross, seven, died in Auckland's Starship Children's Hospital last year, two weeks after a gate fell on her at Amcor Packaging and Dominion Bookbinders in Kerrs Rd, Wiri, south Auckland.
She and her sister Rickylee Peita, 10, had gone with their mother, Lilian Peita, to help with her cleaning job at Amcor.
Moments after they drove through the steel gate it fell on Shaelian, the New Zealand Herald reported today.
In the Manukau District Court yesterday, Judge Charles Blackie said Mrs Peita and her family were still deeply affected, were still grieving and still extremely sad.
The whanau did not want reparation, but he hoped the money would go some way to paying for Shaelian's headstone.
Amcor, which trades as Ryco Dies and shares the driveway with Dominion Bookbinders was ordered to pay $60,000 to Mrs Peita as reparation and fined $20,000.
Dominion Bookbinders was fined $27,000, and Jiffy Cleaning, Ms Peita's employer, $17,000. Jiffy Cleaning director Murray Clinton was fined $1000, and all three firms were fined for not notifying the Department of Labour.
The charges included not taking steps to ensure actions or inactions of employees at work did not harm another person.
