He had attempted to work, but exertion caused suffering, and he was physically unfit for work.
He had a wife and three children, and had no property or income.
His wife kept a boarder, and the amount received from this source constituted his only income.
His brother had a property valued at about 1200, and was married, but had no family.
Witness had received 1 from his brother.
In cross-examination, witness said he had received about 350 four years ago, and with this purchased a property.
This property had since been sold, as he needed money to support himself and family.
During the last four years he had gone through about 400, and had been unable to work for a year and five months.
Defendant gave evidence in his own defence, and said that he had six acres of land and a house at Allenton.
There was a mortgage on the place of 300, and the last valuation of the property was 1085.
Witness was himself in bad health, and was under the doctor at the present time.
He had given his brother 2 in cash, and food had also been given.
The informant had received, in addition to the amount received from the estate, over 50 from his mother. He had also received money from another brother.
There were two other brothers in the family and a sister. When the mother died the estate would be divided.
The magistrate said he had power to make an order against all the brothers, and if all were able to help he would certainly refuse to make one contribute the whole support of the destitute brother.
An order was made for 2s 6d a week, the magistrate stating that the brother ought to make some arrangement by which they could grant relief and take a security over their brother's interest in the estate.
