The Department of Labour confirmed yesterday it had completed its investigation into Roger Steel's death near Millers Flat on December 9 and charges against Delta would be laid under the Health and Safety in Employment Act.
Mr Steel (63), of Alexandra, was killed when the concrete power pole he was working on came out of the ground and toppled over.
Delta chief executive Grady Cameron said the company had fully co-operated with the department's investigation and it would ensure any recommendations were incorporated into its health and safety practices.
It had already completed an independent review of its processes to further strengthen work practices.
"The safety of our people is our number one concern," Mr Cameron said.
