The Australian businessman who crashed his $20 million McLaren F1 sports car near Queenstown in December has been granted diversion by police.

Barry Leigh Fitzgerald (63), of Melbourne, was charged with careless driving after the December 3 smash.

The owner of several McDonalds franchises in Victoria, Fitzgerald did not appear in court and was remanded at large so police could consider diversion.

A Wellington-based police media adviser said Fitzgerald had completed diversion, but would not say what the conditions of his diversion agreement were.

Diversion is a process by which police can deal with offenders out of court. If the offender completes agreed conditions, the charge can be withdrawn and a conviction avoided.

Fitzgerald was on the final leg of a rally of 31 McLarens between Auckland and Queenstown when his 1994 model - capable of reaching 386kmh - ended up in a ditch after skidding off Glenorchy-Queenstown Rd about 9km from the resort.
