Assault charge upgraded to manslaughter

A man originally charged with assaulting a man who later died while being arrested has now been charged with manslaughter.

Adam Palmer, 26, died after a fight with his ex-girlfriend's partner at a house in west Hamilton on August 15.

Police were called to the incident and Mr Palmer was arrested.

They removed the handcuffs from him after his arrest when they became concerned for his wellbeing.

He died soon after at the Dinsdale property despite efforts to resuscitate him.

A 23-year-old man was charged with assault and appeared in Hamilton District Court but police said today that charge had been upgraded to manslaughter.

Detective Inspector Sue Schwalger said the decision was made after careful consideration of the events.

"Police had gone to the address after reports of a struggle going on there between two men and on arriving found Mr Palmer being restrained by a man at that address.

"Tragically Mr Palmer's physical state deteriorated and he was unable to be resuscitated and died a short time later," she said.

An out of district investigator has been appointed to head an police enquiry into Mr Palmer's death because it occurred while in police custody and the Independent Police Conduct Authority has been notified.
