Council pressed to release decision

The Central Otago District Council is being pressed to release its plan change 13 decision by ‘‘frustrated’’ submitters to the controversial proposal.

A letter from barrister James Gardner-Hopkins, on behalf of the Residents for Responsible Development Cromwell, urging the council to release the decision, was sent to council planning officer Adam Vincent this week.

Residents for Responsible Development is one of 410 submitters opposing the plan change.

Council chief executive Sanchia Jacobs said ‘‘at this early stage’’, the council had not considered the points raised in the letter.

‘‘When we have done so, our response will be made back to the letter writer in the first instance,’’ she said.

Last month, it was revealed an independent panel had made a decision on plan change 13.

However, the decision was withheld by the council until administrative matters associated with unpaid fees were resolved.

Earlier this month, River Terrace Developments Ltd made an objection under the Resource Management Act 1991 over fees relating to the plan change.

Council planning and environment executive manager Louise van der Voort said an agreement between both parties had not been reached.

‘‘Our lawyer is working with their lawyer over this matter.

‘‘This is entirely in their hands and we are pushing as hard as we can to resolve this.’’

She said the decision would be released as soon as the council had ‘‘an undertaking to pay the amount owing as determined by the objection process’’.

‘‘We are not requiring the payment to release the decision, but an undertaking that the requester will pay the fair and reasonable processing fees so that the debt does not fall on the ratepayers of the district.’’
