Consent has been granted to Spruce Grove Trust to subdivide land near Millbrook Resort and establish four building platforms, an access allotment, a utilities allotment and two open-space allotments, as the result of an Environment Court hearing.
The trust, established by the Spary family, had previously sought to subdivide the 9.2ha plot, known as Mill Farm Heights, into 10 lots with building platforms on six of the lots as a low-density residential development.
It would have included six properties located on three sides of Millbrook Resort between the western side of the resort and Malaghans Rd, beside Meadow Park.
The application was declined by the Queenstown Lakes District Council and was opposed by a group of affected parties, mainly neighbouring residents at Millbrook Resort.
In their final decision dated June 3, Judge Jane Borthwick and commissioners Charles Manning and Alex Sutherland, all of Christchurch, said they were satisfied with a new survey plan, which showed the location of building platforms on lots 1 to 4 and the removal of lots 5 and 6.
The building platform lots would range in size from 2258sq m to 3047sq m, with the common allotments ranging from 120sq m to 5.5ha.
The parties had also agreed on a new planting plan, with tree planting on lots 5 and 6 also removed.
"A more sensitive approach towards the knoll landform is now proposed; the design endeavours to maintain the openness and legibility of the landform and views to the same."
The commissioners amended wording with regard to height restrictions to give "greater clarity and certainty".
